Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and AqlHR Technologies ("AqlHR," "we," "our," or "us") governing your access to and use of the AqlHR platform, including our website, applications, and services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

AqlHR provides:

• AI-powered HR management platform
• Employee data management and self-service portal
• Payroll processing and WPS compliance
• Leave management and attendance tracking
• Document generation (contracts, letters, certificates)
• Compliance monitoring for Saudi Labor Law, HRSD, GOSI, and Nitaqat
• AI assistant for HR queries and legal guidance
• Performance management and training modules
• Government platform integrations (Qiwa, Mudad, Absher, Sehhaty)

2.1 Account Creation

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

2.2 Account Types

• Organization Account: Created by authorized company representatives
• Administrator Account: Full access to manage organization settings and users
• Employee Account: Access to self-service features as granted by employer

2.3 Age Requirement

You must be at least 18 years old to create an account. By using the Service, you represent that you meet this requirement.

3.1 Subscription Plans

AqlHR offers various subscription plans with different features and pricing. Current plans and pricing are available on our Pricing page.

3.2 Payment Terms

• Subscription fees are billed in advance on a monthly or annual basis
• All fees are quoted and payable in Saudi Riyals (SAR)
• Prices are exclusive of VAT, which will be added where applicable
• Payment is due upon invoice receipt

3.3 Free Trial

We may offer a free trial period. At the end of the trial, your account will automatically convert to a paid subscription unless you cancel before the trial ends.

3.4 Refund Policy

We offer a 30-day money-back guarantee for new subscriptions. After 30 days, subscription fees are non-refundable. Refund requests must be submitted in writing to [email protected].

4.1 Permitted Use

You may use the Service only for lawful purposes and in accordance with these Terms.

4.2 Prohibited Activities

You agree NOT to:

• Use the Service for any illegal purpose or in violation of Saudi law
• Upload false, misleading, or fraudulent information
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or servers
• Use automated systems (bots, scrapers) without authorization
• Reverse engineer, decompile, or disassemble the Service
• Share your account credentials with unauthorized parties
• Use the Service to process data for third parties without authorization
• Violate the intellectual property rights of AqlHR or others

5.1 Data Ownership

You retain ownership of all data you submit to the Service ("Your Data"). By using the Service, you grant AqlHR a limited license to process Your Data solely to provide the Service.

5.2 Data Processing

Our processing of personal data is governed by our Privacy Policy and, where applicable, our Data Processing Agreement. By using the Service, you agree to these documents.

5.3 Data Export

You may export Your Data at any time through the Service's export features. Upon account termination, we will provide a reasonable period to export Your Data.

6.1 AqlHR Property

The Service, including its original content, features, and functionality, is owned by AqlHR and protected by copyright, trademark, and other intellectual property laws.

6.2 License to Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the Service for your internal business purposes.

6.3 Feedback

Any feedback, suggestions, or ideas you provide about the Service may be used by AqlHR without any obligation to you.

7.1 Service Availability

The Service is provided "as is" and "as available." We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free.

7.2 Legal Information

The AI-generated legal information and compliance guidance provided by the Service is for informational purposes only and does not constitute legal advice. You should consult with qualified legal professionals for specific legal matters.

7.3 Limitation of Liability

To the maximum extent permitted by law, AqlHR shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

7.4 Maximum Liability

Our total liability for any claims arising from or related to these Terms or the Service shall not exceed the amount you paid to AqlHR in the twelve (12) months preceding the claim.

8.1 Termination by You

You may terminate your account at any time by contacting us or using the account settings. Termination does not entitle you to a refund of prepaid fees.

8.2 Termination by AqlHR

We may suspend or terminate your access to the Service immediately, without prior notice, for any reason, including breach of these Terms.

8.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. We will retain Your Data for 30 days to allow for export, after which it may be deleted.

9.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia, without regard to its conflict of law provisions.

9.2 Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the competent courts in Riyadh, Kingdom of Saudi Arabia.

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last Updated" date.

Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
